Per Curiam.
Thomas L. Marchand appeals from a district court order denying a NDRCivP 60(b) motion to vacate an order that dismissed, for want of prosecution under NDRCivP 40(e), his negligence action against the city of Harvey. Marchand has failed to establish that the district court abused its discretion in denying Rule 60(b) relief. Accordingly, we affirm under NDRAppP 35.1(a)(4).
