Per Curiam.
Gregory D. Sandvig appeals from a district court judgment awarding his former wife, Candyce C. Sandvig, $40,000 as part of the parties' marital dissolution. The district court, to make a fair and equitable division of the parties' net estate, awarded Candyce Sandvig $40,000 from the proceeds of a $130,000 personal injury settlement paid to Gregory Sandvig during the marriage.
We affirm under Rule 35.1(a)(2) and (4), N.D.R.App.P.
