State: North Dakota
Docket No: 950025
Case Date: 05/31/1995

Wildfang v. Wildfang Civil No. 950025

Per Curiam.

D'Arlen Wildfang appeals from a district court judgment granting her a divorce from Ramon Wildfang and awarding her certain marital property and assets. Because the order for judgment is confusing on whether the district court retained jurisdiction, we direct that the order and judgment be amended to state that the district court retains jurisdiction over spousal support in the event that future circumstances should justify an award. NDRAppP 35(b). See Neppel v. Neppel, 528 N.W.2d 371 (N.D. 1995). The district court's decision not to award periodic spousal support to D'Arlen at this time is not clearly erroneous. Nor is the property division clearly erroneous. Accordingly, we affirm. NDRAppP 35.1(a)(2).

Affirmed as amended.
