State v. David Allen Frey (S055946). Upon consideration by the court. Relator's petition for alternative writ of mandamus is allowed. The court determines that, pursuant to ORS 34.160, a peremptory writ is appropriate. The court has directed that a peremptory writ of mandamus issue. Wherefore, in the name of the State of Oregon, you are commanded to vacate the order denying defendant's motion to postpone the date of trial and allow substitution of counsel, and to enter an order granting defendant's motion.
