DECISION OF DISMISSAL

This matter is before the court on its own motion to dismiss for want of prosecution. A telephone case management conference was held in the above-entitled matter on April 27, 2009. Dee E. Sund (Plaintiff) appeared on behalf of Plaintiffs. Paul E. Meyer, Douglas County Counsel, appeared on behalf of Defendant. Ron Northcraft and Susan Acree, Douglas County appraisers, were present. At the conclusion of the conference, Plaintiff agreed to notify the court in writing if Plaintiffs planned to continue their appeal. Plaintiff did not submit her written statement by the agreed date of May 27, 2009. On June 5, 2009, a member of the court's operation team telephoned Plaintiffs and left a message requesting a return call to the court. On June 11, 2009, Plaintiff telephoned the court, stating that she planned to withdraw her appeal and would put the request in writing. As of this date, Plaintiffs have not responded to the court's request. As a result, the court concludes the appeal should be dismissed. Now, therefore, /// ///
