DECISION AND JUDGMENT OF DISMISSAL

This matter is before the court on plaintiff's oral and written Motion to Dismiss, received August 21, 2001, requesting that the complaint be dismissed. On August 21, 2001, plaintiff telephoned the court requesting that the telephone trial set for August 23, 2001, be canceled because she wanted to dismiss her appeal. On the same day, plaintiff sent an email to the court stating that she wanted to cancel the telephone trial. Plaintiff did not submit any exhibits to the court for its consideration. After careful consideration of plaintiff's failure to submit any evidence for the court's consideration and plaintiff's request to cancel the telephone trial and withdraw her appeal, now, therefore; IT IS HEREBY ADJUDGED AND DECREED that the above-entitled matter be dismissed.
