He had back spasms related to the injury in May 2001 that caused him to be off work until August 2001. Thereafter, he worked until December 2008, when he was permanently laid off due to economic conditions. The settlement of his workers' compensation claim, which was approved by the trial court in July 2001, was based on the two-and-one-half times impairment cap, Tenn. Code Ann.
