OPINION

I. Facts
The defendant, Mila Shaw, was indicted on July 21, 1998, on one count of theft of property over the value of $10,000, but under the value of $60,000, a Class C felony.  The indictment resulted from the following facts.  Ms. Wilhelmein Thompson died from breast cancer on March 25, 1997.
Shortly before her death, the defendant moved in with Ms. Thompson to assist her.  The defendant and Ms. Thompson had been friends for quite some time.  The defendant obtained a notarized power of attorney, signed purportedly by Ms. Thompson.
