A Rutherford County jury convicted the appellant, Ricco Donnell Summers, of one (1) count of possession with the intent to sell over 26 grams of cocaine and one (1) count of possession of drug paraphernalia.  In addition, the Rutherford County Circuit Court, sitting without the jury, found the appellant guilty of one (1) count of possession of a weapon by a convicted felon.  The trial court sentenced the appellant as a Range I offender to concurrent terms of ten (10) years for possession with the intent to sell, eleven (11) months and twenty-nine (29) days for possession of drug paraphernalia and two (2) years for unlawful possession of a weapon.  On appeal, the appellant contends that: (1) the trial court erred in allowing the state to introduce evidence that the appellant was an occupier of Michelle Fleming
