MEMORANDUM OPINION

Laboratory Tops, Inc. d/b/a Durcon Laboratory Tops, Inc. and Durcon Incorporated (collectively, "Durcon") seek reimbursement for property damage resulting from a fire main leak. Durcon claims liability under the Texas Tort Claims Act, alleging that the leak and resulting damage was caused by the City of Taylor's negligent use of motor-driven equipment. See Tex. Civ. Prac. & Rem. Code Ann.
