EX PARTE FELICIA ANN MENDOZA

From the 54th District Court McLennan County, Texas Trial Court # 95-514-CA MEMORANDUM OPINION On October 20, 1998, Felicia Ann Mendoza appealed the denial of a writ of habeas corpus. Mendoza alleged that her detention in the McLennan County jail was illegal because the indictment under which she was being held constituted a double jeopardy violation. On October 30, Mendoza and her attorney signed and filed a motion to dismiss the appeal pursuant to Rule of Procedure 42.2. See Tex. R. App. P. 44.2(a). Rule 42.2(a) states: At any time before the appellate court s decision, the appellate court may dismiss the appeal if the appellant withdraws his or her notice of appeal. The appellant and his or her attorney must sign the withdrawal and file it in duplicate with the appellate clerk, who must immediately send the duplicate copy to the trial court clerk. Id. This cause is dismissed. PER CURIAM
