MEMORANDUM OPINION

This court's opinion and judgment in the above cause was pronounced on November 29, 1990. Thereafter, to wit, on
December 5, 1990, the Appellee filed two motions:
(1) A motion to supplement the transcript by showing the existence of a supersedeas bond which had been filed in the
trial court on November 15, 1989, together with the trial court's order reviewing said bond entered on December 19,
1989. This supersedeas bond was executed by Appellant Gerard Dean as principal and Jack Traylor as surety.
(2) A motion to modify the judgment of this court to provide for judgment against Jack Traylor, Appellant's surety on
said bond.
Both of the two above motions are hereby granted. The judgment entered on November 29, 1990, is hereby set aside
and the judgment dated this date is substituted therefor.
Moreover, on December 13, 1990, the Appellant filed his Motion for Rehearing in this cause, which motion is hereby
overruled.
