Memorandum Opinion on Motion for Rehearing Before QUINN, C.J., CAMPBELL, J., and BOYD, S.J.1 Pending before the court is the State's motion for rehearing. We grant the

motion, withdraw our opinion, and dismiss the appeal for want of jurisdiction. Appellant Jack E. Whitney seeks to appeal the trial court's finding that he has failed to present sufficient evidence in order for a writ to be granted. The State contends this court is without jurisdiction. This is so, according to the State, because art. 11.07 of the Texas Code of Criminal Procedure implicates the jurisdiction of only the convicting court and
