BEFORE JUSTICES HOWELL, ROWE AND WHITTINGTON FN:1 OPINION BY JUSTICE WHITTINGTON JANUARY 27, 1989 Max and Joanne Brenner contracted with Stephen Woodward d/b/a Haywood Construction Company to perform home remodeling work. After problems arose concerning construction details, the Brenners filed suit to recover damages from Woodward on theories of breach of contract, breach of warranty, and violations of the Texas Deceptive Trade Practices Act. Additionally, the Brenners brought a DTPA action against Crump Insurance Services, Inc. for misrepresentations concerning the issuance of a performance bond. Woodward filed counterclaims against the Brenners for breach of contract and to establish and foreclose upon a mechanic's lien. Woodward and Crump both sought to recover attorney's fees on the basis that the DTPA suit was groundless and brought in bad faith or for the purposes of harassment. TEX. BUS. & COM. CODE ANN.
