Delivered and Filed: November 26, 2008 AFFIRMED Latietta Cay was injured on the job and had to undergo back surgery. Cay's employer, Normandy Terrace Nursing Home, had workers' compensation insurance with Connecticut Indemnity Company ("Connecticut Indemnity"), which contested the compensability of Cay's injury. Following an adverse decision by the Texas Workers' Compensation Commission Appeals Panel, Cay filed suit in district court for judicial review of the Appeals Panel's decision. The trial court ultimately granted Cay's motions for summary judgment, finding Connecticut Indemnity had waived
